OXO Driver Policy
This policy applies to your use of the Services as a Driver. For the purposes of this guide, a ‘Vehicle’ means any vehicle you rent through the Services.
By renting with us, you agree to the following terms:
Proper Care and Service Period Procedures
You agree to drive and park with reasonable care, keep the Vehicle clean, and return it on time. Prohibited uses include the following:
- Permitting an unapproved driver to operate Vehicle
- Using the Vehicle to push or tow anything, including a trailer
- Using the Vehicle on any other than paved roads (off roading)
- Using the Vehicle for racing
- Using the Vehicle to carry passengers other than in the interior or cab of the Vehicle
- Carrying passengers or anything else in excess of the capacity of the Vehicle
- Using the Vehicle during a commission of a crime or any dangerous activities
- Using the Vehicle while under the influence of drugs or alcohol
- Using the Vehicle while outside of the United States or Canada
- Using the Vehicle to transport hazardous substances or animals
- Using the Vehicle for primary purposes other than professional transportation of persons or property as permitted by Owner
- No smoking in the vehicle
- No using the car with an intent that is abusive or abnormal for its operation
- No placing stickers, signs, symbols, or other devices, modifications, advertisements, or publicity materials on the car without OXO’s explicit permission
- No picking up hitchhikers with the vehicle
- No operating devices that require one or both hands while driving
We encourage you to return the car in better condition than at the start of your Service Period. You understand and agree that you must return the Vehicle in at least the same condition as at the start of your Service Period. You further understand and agree that returning a Vehicle in an unclean state, such as with excessive dirt or mess, may result in charges outlined in Section 9 of our Terms of Service – ‘Fees and Payments’.
Secure the Vehicle
If you leave the car parked at any time during or at the end of your Service Period, you must lock and secure the Vehicle doors and windows. You agree and understand that failure to do so may result in charges outlined in Sections 7 (Terms Specific for Drivers) and 9 (Fees and Payments) of our Terms of Service, including any resulting costs arising from your failure to secure the Vehicle.
You agree to return the car with at least the same amount of fuel in the tank as there was at the start of your Service Period. If the fuel is not filled back to the level present at the start of your Service Period, you may be charged fees and/or fines. You further agree that you are responsible for refueling the car with the correct fuel type and you accept full liability for any damage or loss caused by refueling a Vehicle with the incorrect fuel type.
You understand and agree that no pets are allowed in a Vehicle except where explicitly approved in writing. In all cases, you agree to provide and keep your pet in a carrier cage during the Service Period and to return the Vehicle in a clean condition free of pet hair and pet waste.
You agree that you will not smoke in any Vehicle and you understand that you may be fined for violating this Driver Policy.
You may not drive the Vehicle outside of the United States. Cars may not be driven to Mexico, or any other destination outside of the United States.
No Illegal or Illicit Activities
You may not carry out a crime or participate in any other illegal activity while operating a Vehicle.
Normal Operation Only
You may not use a Vehicle for any negligent use where the intent is abusive or abnormal for its operation.
Authorized Drivers Only
You agree that you have reviewed and meet the “Who May Use the Services” requirements outlined in Section 5 of our Terms of Service prior to each Service Period. You understand and agree that, should not permit anyone else to operate a Vehicle during a Service Period on your account.
Document All Damage
Before driving the Vehicle, you can submit an inspection report including photos of any pre-existing damage through the Services. You understand and agree that you may be liable for any damage that you fail to report before driving the Vehicle, at the discretion of OXO.
Traffic Tickets and Moving Violations
You understand and agree that you are solely liable for traffic tickets and moving violations, and any other traffic violations that occur during your Service Period, including all resulting fees. You understand and agree that OXO may choose to challenge, settle, or assign to you violations that occur during your Service Period; and you authorize OXO to release information relating to your account to any government agency or court necessary to settle such claims.
Parking Tickets and Street Parking
You understand and agree that you are solely liable for parking tickets and citations that occur during your Service Period, including all resulting costs such as towing, impound, retrieval, and administrative charges. You agree to pay these fees in a timely manner and to comply with all legal obligations that arise from such violations. If you agree with the Owner to park a Vehicle at the end of your Service Period, rather than returning the Vehicle in person, you understand and agree that you will park the Vehicle legally and in compliance with all bylaws, including curbing of the Vehicle wheels as required, in a spot that is legal, unrestricted, and not subject to ticketing, towing, impound, or citation to allow for the Owner to take back possession of the Vehicle. You understand and agree that OXO may choose to challenge, settle, or assign to you tickets and citations that occur during your Service Period; and you authorize OXO to release information relating to your account to any government agency or court necessary to settle such claims.
You are solely responsible for paying all tolls in a timely manner and for complying with all legal obligations. If there are any unpaid tolls, you understand and agree that your primary credit card on file with our Services may be charged for the price of the toll along with any administrative fees we may charge.
If your own negligence contributes to the breakdown or need for roadside assistance, you understand and agree that you are solely responsible for all roadside assistance costs, including all resulting costs such as towing, impound, retrieval, and administrative charges, and that you may be additionally charged.
Stickers and Vehicle Modification
You may not place stickers, signs, symbols, or other devices, modifications, advertisements, or publicity materials on the interior or exterior of a Vehicle without the explicit permission of OXO.
You may not pick up hitchhikers or persons unknown to you while in a Vehicle, whether before, during, or after a Service Period.
Drivers may not operate the Vehicle while under the influence of any prescription or non-prescription drug for which driving during use is not recommended on the label, or by reasonable opinion of a pharmacist or doctor.
You may not operate devices that require one or both hands while driving, including but not limited to cell phones, mobile computers, or devices that allow texting. We discourage you from engaging in any activity that takes your attention off the road while driving.
You must obey all applicable seat belt laws while in a Vehicle. We recommend that every person in the Vehicle wear a seatbelt at all times.
You may not drive while wearing any device that limits your ability to hear, see, and otherwise judge driving conditions. You must follow all applicable laws governing headphone use in a Vehicle, which may differ state by state.
Maintenance and Repairs
You are not responsible for routine maintenance and repairs of a Vehicle. You may be held liable for the repair cost for of all other repairs of damage to the car during the Service Period and must follow the reporting, claims processing, and repair procedure set forth below for all such damage.
If you incur any traffic incident or driving violation that affects your eligibility as an Authorized Driver on the Services as described in Eligibility Requirements, you agree and understand that you immediately become ineligible and are no longer considered an Authorized Driver. You agree and understand that immediately you must indemnify both OXO and the respective Owner for any losses that might occur as a result of your continued operation of a Vehicle.
For every Service Period, you understand and agree to be charged a fees as outlined in our Section 9 of our Terms of Service – ‘Fees and Payments’.
You agree and understand that a one-time deposit of $150 may be held from your first Service Period and will be released back to your payment card no later than ten (10) business days after the date of your last Service Period.
You agree and understand that cancelling a Service Period may result in your primary credit card on the Services being charged as outlined in Section 9 of our Terms of Service – ‘Fees and Payments’.
You agree and understand that returning Vehicle late, after the end of your Service Period, may result in a being charged fees as outlined in our Section 7(d) of our Terms of Service – ‘Receipt and Return of Vehicle’.
You agree and understand that every Vehicle on the Services has a mileage limit specified when you book your Service Period. You agree and understand that, by default, all cars have a mileage limit of 25 miles per Service Period hour up to a maximum of 250 miles per day.
By renting a manual transmission Vehicle (“MT Vehicle”), you warrant that you have sufficient driving experience to properly and safely operate the MT Vehicle. You understand and agree that you are solely responsible for all costs arising from your improper driving of a MT Vehicle, including all repair, servicing, replacement, and administrative charges incurred to return the MT Vehicle to proper working order.
You agree that any violations of this Driver Policy or our Terms of Service from actions taken by you may result in costs charged to your account, at OXO’s sole discretion, to recover all resulting and administrative costs.
Insurance Claims and Reporting Procedures
Solely during your Service Period, the Vehicle is covered by OXO’s insurance policy. You agree that you have reviewed the terms of coverage outlined in our insurance documentation.
Filing a Claim
If a Vehicle is damaged during your Service Period, it is your responsibility to gather relevant information and submit an insurance claim to us within 48 hours of the incident. You understand and agree to file by emailing email@example.com no later than 48 hours after the end of the incident for OXO insurance coverage to apply, unless you are rendered incapable of doing so. You understand and agree to detail the full nature of the claim and allow time for damage or loss assessment, dispute arbitration, or remediation at OXO’s sole discretion. You understand and agree that failing to file a claim within 48 hours of the event occurring may forfeit OXO insurance cover during your Service Period and you will be solely responsible for all repairs and any loss or liability arising from the incident.
You understand and agree that as part of filing a claim for a loss, your primary payment card on the Services will be charged fees outlined in our Section 7(c) of our Terms of Service – ‘Driver Responsibilities’ and that the fees may be charged regardless of whether you are at fault for the loss. At the conclusion of the claim, a part of or the full fees may be returned to you should the loss amount not exceed the full fees or if another party is deemed responsible for the loss.
Negligence, Misuse, or Breach
You understand that any negligence, misuse, or breach of this Driver Policy or our Terms of Service may void your OXO insurance coverage and that you will be solely liable for any damage, liability, or loss arising from your actions.
You understand and agree that, in assessing any damage or loss, we will utilize the services of a professional vendor approved by OXO at our sole discretion or an approved vendor selected by insurance provider representing the liable party.
You understand and agree that personal items left in the car are not covered by OXO’s insurance policy before, during, or after a Service Period. It is your responsibility to remove personal belongings from the Vehicle when you are not present with it.
